These Terms of Service ("Terms") govern your access to and use of the True Heart website located at trueheartapp.com (the "Site") and any related services (collectively, the "Service"), operated by Bella Truehart LLC ("Company," "we," "us," or "our"). By accessing the Site or submitting information through any form, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years of age to use this Site. By using the Site, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

2. Alpha Access Program

Submission of your email address on this Site constitutes an application for early ("alpha") access to the True Heart product. Submission does not guarantee acceptance. We reserve the right to accept or decline any application at our sole discretion, with or without reason. Alpha testers who are accepted may be required to sign a separate Non-Disclosure Agreement (NDA) prior to gaining access to the product.

3. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable laws or regulations.
  • Submit false, misleading, or fraudulent information through any form on the Site.
  • Attempt to gain unauthorized access to any portion of the Site or its underlying systems.
  • Use automated scripts, bots, or other tools to scrape, crawl, or interact with the Site.
  • Interfere with or disrupt the integrity or performance of the Site.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.

4. Intellectual Property

All content on the Site — including text, design, graphics, logos, and code — is the exclusive property of Bella Truehart LLC and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written consent.

5. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. True Heart is an AI-powered companion application. It is not a licensed mental health service, therapy practice, or medical service. Nothing on this Site or within the True Heart application constitutes professional psychological, psychiatric, or medical advice, diagnosis, or treatment. If you are experiencing a mental health crisis or emergency, please contact a qualified professional or call emergency services immediately.

8. Third-Party Links

The Site may contain links to third-party websites. These links are provided for convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to this page with a revised effective date. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms.

11. Governing Law

By creating an account, downloading, or using Trueheart, you confirm you are 18+, have read and understood these Terms, and agree to be legally bound. If you do not agree, do not use the Service.

1.2 Description of Service

Trueheart is an AI-assisted emotional support and personal development app for heartbreak, grief, and emotional recovery. It provides journaling tools, AI reflections, guided exercises, and curated content. It is not a medical device, therapy platform, or licensed clinical service.

1.3 Eligibility

  • Be at least 18 years old
  • Have legal capacity to enter a binding agreement
  • Not be barred from receiving the Service under applicable law
  • Reside in a jurisdiction where the Service is available

1.4 Account Registration

You must provide accurate information, keep credentials confidential, and notify us immediately at support@trueheartapp.com of unauthorized use.

1.5 Subscription & Payment

  • Paid plans may include recurring charges
  • Fees billed in advance (monthly or annual)
  • Fees are non-refundable except where required by law or our Refund Policy
  • Pricing may be modified with 30 days advance notice

1.6 Prohibited Conduct

  • Unlawful use or Terms violations
  • Reverse engineering, decompiling, hacking, botting, or security circumvention
  • Abusive/defamatory/infringing content or impersonation
  • Sharing third-party private information without explicit written consent

1.7 Intellectual Property & AI Hallucination Disclaimer

All app content and methodology are owned by or licensed to TrueHeart App LLC. You receive a limited, non-exclusive, non-transferable personal-use license.

AI outputs may be inaccurate, incomplete, or contextually inappropriate. Do not rely solely on AI content for important decisions. The Company disclaims liability for reliance on AI-generated content.

1.8 Disclaimer of Warranties

1.9 Limitation of Liability & Indemnification

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUEHEART APP LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

You agree to defend, indemnify, and hold harmless TrueHeart App LLC from third-party claims arising from your breach of Terms, unlawful use, unauthorized sharing of third-party private information, or submitted content.

1.10 Termination

We may suspend or terminate accounts for conduct violating these Terms or harmful conduct. License ends immediately on termination. Sections on IP, disclaimers, liability, and dispute resolution survive.

1.11 Governing Law & Dispute Resolution

Texas law governs. Disputes are subject to 30 days good-faith negotiation, then binding arbitration in Texas under AAA Commercial Rules. You waive jury trial and class action/class arbitration rights.

1.12 Changes to Terms

We may update these Terms and will provide at least 14 days notice for material changes. Continued use constitutes acceptance.

Mental Health & AI Disclaimer

3.1 Nature of the Service

Trueheart provides AI-assisted emotional support for educational, reflective, and wellness purposes only. It does not create a therapist-patient relationship.

3.2 Limitations of AI Support

  • AI cannot assess your full clinical or social context
  • AI output may be inaccurate/incomplete (hallucinations)
  • AI is not suitable for psychiatric emergencies

3.3 Assumption of Risk

You use the Service voluntarily and at your own risk.

3.4 Mandatory Crisis Protocol

Best-effort crisis detection may suspend sessions and show emergency resources. This is not guaranteed to detect all crises. If you are in crisis, do not rely on the app alone.

3.6 Professional Care Recommendation

Trueheart is designed to complement, not replace, licensed professional care.

Informed Consent (AI-Assisted Support)

4.1 What You Consent To

  • Interacting with an AI companion that has no clinical judgment or licensure
  • Storage of journal/mood/conversation data per Privacy Policy
  • Use of aggregated de-identified data to improve safety and quality

4.2 Nature of AI Interactions

AI responses may vary and may be inaccurate. Do not rely solely on AI-generated content for important decisions.

4.3 Right to Withdraw

You may decline AI interaction, request deletion, disable AI features, or close your account at any time.

4.4 Confidentiality Limits

  • Trueheart is not currently a HIPAA-covered service
  • Disclosure may occur if required by valid legal process
  • Crisis session suspension is a safety control, not a confidentiality breach

4.5 Click-Wrap Acknowledgment

By clicking "I Agree," you confirm you are 18+, understand Trueheart is not therapy, accept AI limitations (including hallucinations), and consent to data practices described in these documents.

End User License Agreement (EULA)

5.1 License Grant

We grant a limited, non-exclusive, non-transferable, revocable license to install and use the app for personal, non-commercial use.

5.2 Restrictions

  • No copying/modifying/distributing source or app components
  • No sublicensing/resale/transfer
  • No reverse engineering or disassembly
  • No removal of proprietary notices
  • No use to build a competing product or train competing AI

5.3 Apple App Store Terms

This EULA is between you and TrueHeart App LLC (not Apple). Apple has no support obligations and is a third-party beneficiary.

5.4 Google Play Terms

This EULA is between you and TrueHeart App LLC (not Google). Google has no support obligations and is a third-party beneficiary.

5.5 Updates

Updates may be provided automatically. Continued use after updates means acceptance.

5.6 Termination

Your license ends automatically upon non-compliance.

5.7 Disclaimer & Limitation

App is provided "as is" without warranties; liability is limited to the maximum extent allowed by law.

7.4 Chargebacks

Fraudulent chargebacks may constitute material breach and may result in account action.

7.5 Refund Eligibility

  • First-time subscriber within 48 hours with no substantial use

Store-processed purchases are governed by Apple/Google refund policies.
